What Exactly Is
a Trademark?

A trademark is a legal registration that gives you exclusive rights to use a specific name, logo, or slogan in connection with your goods or services in India. Once registered, no one else can legally use the same or a confusingly similar mark in your category of business. You gain the right to take legal action if they do.

A trademark protects your brand identity. It does not protect the product itself (that’s a patent), or the creative work behind it (that’s copyright). It protects the name and mark you trade under the thing your customers recognise as yours.

Registered trademarks in India are valid for 10 years from the filing date and can be renewed indefinitely. Once registered, your mark belongs to you in perpetuity, as long as you keep renewing it.

Trademark Pending

You can use the ™ symbol as soon as LexBridge files your application. It signals to the market that you’ve claimed the mark and an application is in progress. Valid from day one of filing.

Registered Trademark

The ® symbol can only be used once the Indian Trademark Registry issues your Registration Certificate typically 12–18 months after filing. Using ® before registration is a legal offence in India.

Intake & Brief

You tell us your brand name, logo (if applicable), and the nature of your business. We confirm scope, advise on the correct class or classes, and send you a checklist of everything needed to proceed.

Trademark Availability Search

Before filing, Ujjwal conducts a full search on the IP India portal to check for identical or confusingly similar existing marks in your class. This reduces the risk of objection or rejection after filing and lets us flag any conflicts before you commit.

03.

Application Preparation

We prepare Form TM-A with your full applicant details, trademark representation, class selection, and description of goods or services. We also prepare your Power of Attorney (Form TM-48), you review, sign, and return it. This authorises Ujjwal to file and correspond with the Registry on your behalf.

04.

Electronic Filing on IP India

Your application is filed electronically through the IP India portal. You receive a filing acknowledgment with your official application number. From this date, your trademark is legally protected even before registration is complete.

Examination & Objection Response

The Registry examines your application and may raise objections either on absolute grounds (e.g., the mark is too descriptive) or relative grounds (conflict with an existing mark). If an objection is raised, Ujjwal prepares and submits a formal legal response within the required 30-day window. One full round of objection response is included in the Base Service Fee.

Publication & Opposition Defense

Once accepted, your mark is published in the official Trademarks Journal. A 4-month window follows during which any third party can file an opposition. Registration Certificate Issued

Can I register a trademark in India if I live abroad?
Yes. NRIs and foreign nationals can register trademarks in India, but all applications must be filed through a licensed Indian Advocate or registered trademark agent, you cannot file directly from overseas. LexBridge handles this entirely through Ujjwal Singh, a licensed India-based Advocate. You don’t need to travel to India or appear in person at any stage.
If a third party files an opposition during the 4-month journal publication window, LexBridge handles the full defense including preparing your counter-statement, filing responses, and representing your position through the opposition proceedings.
