An old divorce case may be finished, but obtaining the right document for use abroad can still require a careful court-record search. Start by identifying the court and the exact document the receiving authority needs: a judgment, final decree, certified order or evidence addressing finality.

Who this guide is for

This guide is for a party to an Indian divorce who now lives abroad and needs a certified copy of an existing court record for immigration, remarriage or another official purpose. It does not explain how to start a new divorce or determine whether a foreign country recognises a particular divorce.

Judgment, decree and online download

A judgment explains a court’s decision; the formal decree or operative order may be a separate document. Ask the recipient what it requires. A case-status page, screenshot or ordinary downloaded order should not automatically be treated as the required certified court copy.

The Supreme Court e-Committee’s eCourts service supports searches for case status, orders and judgments using available case identifiers. This can help locate the matter, but finding it online and obtaining the required certified copy are separate steps.

Identify the issuing court and record room

Gather the court’s name and district, case number and year, names used by the parties at the time, decision date, CNR number if available, and details of the lawyer who handled the matter. An old copy, summons or correspondence can help when the case number is incomplete.

Older files may have moved to a record room or successor court. Missing digitisation does not establish that the decree never existed. Conversely, the existence of a digital case entry does not guarantee that every historical paper survives or can be released without an application.

Applying for a certified copy

The relevant court’s copying rules determine eligibility, application format, fees and certification. As an example, the High Court of Delhi describes digital and manual certified-copy processes. Its rules are not a nationwide checklist for every Family Court or District Court.

  1. Confirm the record-holding court and exact documents requested.
  2. Check who may apply and what identity or party-status evidence is needed.
  3. Arrange any required authority, vakalatnama or POA through an appropriate professional.
  4. Submit the copy application and retain its acknowledgement.
  5. Review the issued copy for completeness, court certification and matching case details.

Family proceedings may involve access restrictions. Being related to a party does not automatically entitle someone to the entire file.

Working from abroad and the role of an Advocate

A permitted representative may be able to coordinate a copy request without the applicant travelling. Whether this is possible depends on the court, record and applicant’s capacity. Have any overseas authorisation drafted for the actual task before arranging notarisation, apostille or consular attestation.

If an application requires legal representation, an appearance or an order, a separately engaged Advocate or appropriately qualified or authorised professional must handle that work. LexBridge8 itself is not a law firm or court representative. No coordinator can promise to override a court’s access rules.

Authentication, translation and foreign recognition

Ask the receiving authority whether it needs the decree, judgment, proof of finality or appeal status, and what translation or authentication applies. An apostille authenticates the relevant public-document origin; it does not determine whether a foreign immigration or marriage authority recognises the divorce. MEA e-Sanad explains the limits of apostille certification.

A private divorce deed, separation agreement and final court decree should not be treated as interchangeable. Where the legal effect of the record is uncertain, obtain advice in the relevant jurisdiction before ordering ancillary services.

Timing and costs

A readily available recent record differs from a decades-old file needing archive identification. Court vacations, staff availability, missing references, record transfers and permission applications may affect timing. Ask for stage-based estimates, not a guaranteed nationwide number of days.

An additional Complex Case / Required Appearance Professional Handling Fee — From USD 300 additional may apply to any service where the work requires an SDM or court-issued route, a hearing, interview, in-person or professional attendance, materially expanded handling, or complex multi-authority coordination. The case-specific fee is quoted and agreed before additional work starts. Government, court and filing fees, travel, courier and other third-party expenses remain separate Actual Costs. Any legal representation or professional appearance is handled by a separately engaged Advocate or an appropriately qualified or authorised professional.

Frequently asked questions

Can I obtain the copy without returning to India?

Possibly, if the court permits the proposed representative and procedure. Confirm this before relying on it.

What if I do not know the case number?

Start with party names, the approximate decision year, court location and old lawyer details. A search may still be possible, but success and timing cannot be guaranteed.

Does an apostille prove that my divorce is final?

No. Finality and recognition are separate questions. The recipient may require additional court evidence or legal review.
